The nine essays in this volume resulted from a symposium on "criminal justice and punishment" at the University of Nebraska at Omaha, in response to concerns about the workability and defensibility of any system of punishment. Among the contributors are Professors of Philosophy, Law, and Government, and the executive director of a Law Enforcement Commission. What emerges as the central focus of the book is a predominant interest in "retributivism." As J. B. Cederblom writes in the introduction, the retributive or (...) "just deserts" theory of punishment has come to dominate at the present time. The extent to which the retributivist position is promoted in opposition to an indistinct representation of utilitarianism, makes the book less challenging as a statement of the retributive position on punishment. Without a doubt, the more recent works of R. M. Hare and David Lyons, among others writing on utilitarian theory, do much to make easy claims against the theory appear facile if not naive. It is interesting that the bibliography does not refer to Hare’s work and mentions only one essay by Lyons. This is not to condemn the book, however, for it serves an important role in reawakening philosophers to the importance of a long-standing debate with a revived and healthy retributivism. But it is a warning that it is oftentimes too easy to defend a position when the opposition is not represented at the hearing. (shrink)

Variant Creutzfeldt–Jakob disease is a fatal, transmissible, neurodegenerative disorder for which there is currently no effective treatment. vCJD arose from the zoonotic spread of bovine spongiform encephalopathy. There is now compelling evidence for human to human transmission through blood transfusions from presymptomatic carriers and experts are warning that the real epidemic may be yet to come. Imperatives exist for the development of reliable, non-invasive presymptomatic diagnostic tests. Research into such tests is well advanced. In this article the ethical implications of (...) the availability of these tests are elaborated and comparisons drawn with predictive genetic testing for Huntington’s disease and screening for HIV. Paramount to considerations is the issue of whom to test, weighing up respect for personal autonomy against obligations to benefit and protect society. A paradigm is proposed similar to that used for HIV screening but with unique features: compulsory testing of all blood/organ donors and individuals undergoing surgery or invasive procedures who have a significant risk of disease transmission. We present here a direct elementary construction of continuous utility functions on perfectly separable totally preordered sets that does not make use of the well-known Debreu’s open gap lemma. This new construction leans on the concept of a separating countable decreasing scale. Starting from a perfectly separable totally ordered structure, we give an explicit construction of a separating countable decreasing scale, from which we show how to get a continuous utility map.

RATIONALE, AIMS AND OBJECTIVES: This paper deals with the problem of surgical waiting lists and is aimed, in particular, at comparing two different prioritization approaches: (1) the clinical assessment of treatment urgency aimed at categorizing patients into urgency-related groups (URGs) with a given recommended maximum waiting time for treatment; and (2) the implementation of an original prioritization scoring algorithm aimed at determining the relative priority of each patient in the waiting list and the corresponding order of admission. METHODS: A modelling (...) exercise based on a cohort of 236 patients enrolled on the waiting list of a surgical department in an Italian public university hospital, from 1 January to 30 June 2004, is presented. The comparison is based on a measure called need-adjusted-waiting-days, which allows to take into proper account both urgency and priority. RESULTS: The results show that both methods should be implemented simultaneously for increasing the department's performance in terms of both efficiency--outcome gained from a given amount of resources--and equity--how patients are admitted according to their need. CONCLUSIONS: Waiting list prioritization should not be limited to classifying patients into URGs, but to using a scoring system as well, in order to schedule patient admissions in an explicit and transparent way. _Purpose._ The authors aim to disclose the anthropological dimension of ecocide during and after Russia’s war against Ukraine, relying on the multidisciplinary practices and intellectual production of ecofeminist women thinkers, including philosophers, sociologists, historians, psychologists, and others. _The theoretical basis_ methodological approaches in philosophical anthropology, phenomenology, analytical philosophy, communicative philosophy, existentialism, ethics of justice, and ethics of care determine the study’s theoretical basis._ Originality._ For the first time, a systematic analysis of the anthropological dimension of ecocide has been carried out (...) based on ecofeminist methodology. The specifics of the Ukrainian resistance to ecocide were revealed as part of a single struggle – an anti-imperial and ecological struggle for independence and prosperity. It is emphasized that during the war, the opposition to ecocide is a component of the fight for national sovereignty and territorial integrity of the country, and therefore, the ideas of pacifism in this period are subordinated to this primary goal. After the war, preventing threats of ecocide should become an integral part of the struggle for stable peace and prosperity. Ecofeminist pacifist perspectives should be a priority among the most essential goals for that period. _Conclusions._ Ecofeminist methodological assessments offer valuable insights into the anthropological dimension of ecocide in wartime and post-war contexts, highlighting the complex interplay between gender, violence, and environmental destruction. By focusing on the experiences and perspectives of women and marginalized communities, ecofeminist analyses contribute to a more holistic understanding of ecocide and its impacts on both human populations and ecosystems. The hemidesmosome is a complex junction containing many proteins. The keratin cytoskeleton attaches to its cytoplasmic plaque, while its transmembrane elements interact with components of the extracellular matrix. Hemidesmosome assembly involves recruitment of α6β4 integrin heterodimers, as well as cytoskeletal elements and cytoskeleton-associated proteins to the cell surface. In our cell culture models, these phenomena appear to be triggered by laminin-5 in the extracellular matrix. Cell interaction with laminin-5 apparently induces both phosphorylation and dephosphorylation of subunits of α6β4 integrin. There (...) is emerging evidence that such events are necessary for subsequent cytoskeleton anchorage to the hemidesmosome cytoplasmic plaque. Once assembled, the hemidesmosome plays an essential role in maintaining firm epithelial adhesion to the basement membrane, with hemidesmosome disruption being a hallmark of certain devastating blistering diseases. However, the hemidesmosome is more than just a stable anchor, as it may also be the site of signal transduction, mediated by its α6β4 integrin component. The origin of marine invertebrate larvae has been an area of controversy in developmental evolution for over a century. Here, we address the question of whether a pelagic “larval” or benthic “adult” morphology originated first in metazoan lineages by testing the hypothesis that particular gene co-option patterns will be associated with the origin of feeding, indirect developing larval forms. Empirical evidence bearing on this hypothesis is derivable from gene expression studies of the sea urchin larval gut of two closely related (...) but differently developing congenerics, Heliocidaris tuberculata (feeding indirect-developing larva) and H. erythrogramma (nonfeeding direct developer), given two subsidiary hypotheses. (1) If larval gut gene expression in H. tuberculata was co-opted from an ancestral adult expression pattern, then the gut expression pattern will remain in adult H. erythrogramma despite its direct development. (2) Genes expressed in the larval gut of H. tuberculata will not have a coordinated expression pattern in H. erythrogramma larvae due to loss of a functional gut. Five structural genes expressed in the invaginating archenteron of H. tuberculata during gastrulation exhibit substantially different expression patterns in H. erythrogramma with only one remaining endoderm specific. Expression of these genes in the adult of H. erythrogramma and larval gut of H. tuberculata, but not in H. erythrogramma larval endoderm, supports the hypothesis that they first played roles in the formation of adult structures and were subsequently recruited into larval ontogeny during the origin and evolution of feeding planktotrophic deuterostome larvae. The preparation of layers of amorphous Se by plasma-enhanced CVD using the hydride H2Se as precursor gas is described. Information concerning the structure of the films was obtained from Raman spectroscopy. The spectra of amorphous Se indicated that the dominant molecular structure is the eight-membered ring and/or a chain with Se8 molecular fragments. This material exhibited reversible photodarkening when illuminated at 77 K. In order to explain this phenomenon, we propose a mechanism which takes into account the role of the (...) lone-pair electron orbitals of Se in their contribution to structural ordering. Illumination can cause a distortion in the normal bonding direction between nearest-neighbour Se atoms and induce in this way intrinsic defect states located at the band edges. In the photo-darkened state, optical transition will occur between these defect states. (shrink)

Frank Jackson’s defense of a Lockean representationalist theory of perception is both tightly and boldly argued. It is a first-rate analytic dissection of the relevant arguments for and objections against the representationalist position and takes up swords with D. M. Armstrong, J. J. C. Smart, G. J. Warnock, Aune, Anscombe, Price, and others, with meticulous care. It is equally forthright in accepting and defending implications of the theory which have heretofore, for one reason or another, caused the less clear and (...) more timid to quiver, if not tremble. For example, in dealing with the question whether sense-data exist in space, he writes, "I am sometimes asked why I do not follow the lead of those who locate mental objects in a special, private space. To me, this is like saying, ‘I find it mysterious that mental objects are in normal space, so I will locate them in mysterious space'". (shrink)

Having known classical wave optics and wave mechanics, can we reverse Schrödinger's path and extend the concept of families of rays of light to provide a new exact rendering of quantum optics including the Bose nature of photons? This question is answered in the affirmative, and the implications of the Bose symmetry for certain nonlocal correlations of the many-ray distribution functions are worked out. The similarities and the differences between classical and quantum wave optics are brought out. The ray-ray Bose (...) correlation is analyzed. The generating functional for the many-ray distribution functions is formulated; and the notion of paraxial illumination for quantum optics is made precise. (shrink)

Aims and background: The present work assessed the impact of two decrees on ethics committees in Italy, aimed at bringing the national laws on the conduct of clinical trials into line with the rest of the EC, and regulating and facilitating not-for-profit research.Material and methods: Prospectively collected data from an Italian multicentre study were examined with respect to the ethics review process. Administrative and time elements of the review process were audited. Main outcome measures were time between the application submission (...) and the ethics committee definitive opinion, type and number of application submission forms, number of ethics committees that refused fee exemption, and time between the ethics committee approval and the administrative authorisation.Results: A total of 134 local research ethics committees were approached. Application submission procedures and application forms varied greatly; paper submission was mandatory. The median time from submission to approval was 72 days. Only two LRECs refused the fee exemption. The median time from LREC approval to administrative agreement was 50 days and only 9.6% of local authorities came to a verbal agreement with the sponsor.Conclusions: Italian LRECs are still not sufficiently efficient in complying with the Directive 2001/20/EC requirement . Better coordination of LRECs work is needed although the optimal level of coordination between them is still not known. In the meantime, national guidelines are needed concerning the application of Directive 2001/20/EC. The behaviour of Italian LRECs towards not-for-profit research was excellent although only the fee exemption was requested. (shrink)

The larval arms of echinoid plutei are used for locomotion and feeding. They are composed of internal calcite skeletal rods covered by an ectoderm layer bearing a ciliary band. Skeletogenesis includes an autonomous molecular differentiation program in primary mesenchyme cells (PMCs), initiated when PMCs leave the vegetal plate for the blastocoel, and a patterning of the differentiated skeletal units that requires molecular cues from the overlaying ectoderm. The arms represent a larval feature that arose in the echinoid lineage during the (...) Paleozoic and offers a subject for the study of gene co-option in the evolution of novel larval features. We isolated new molecular markers in two closely related but differently developing species, Heliocidaris tuberculata and Heliocidaris erythrogramma. We report the expression of a larval arm-associated ectoderm gene tetraspanin, as well as two new PMC markers, advillin and carbonic anhydrase. Tetraspanin localizes to the animal half of blastula stage H. tuberculata and then undergoes a restriction into the putative oral ectoderm and future location of the postoral arms, where it continues to be expressed at the leading edge of both the postoral and anterolateral arms. In H. erythrogramma, its expression initiates in the animal half of blastulae and expands over the entire ectoderm from gastrulation onward. Advillin and carbonic anhydrase are upregulated in the PMCs postgastrulation and localized to the leading edge of the growing larval arms of H. tuberculata but do not exhibit coordinated expression in H. erythrogramma larvae. The tight spatiotemporal regulation of these genes in H. tuberculata along with other ontogenetic and phylogenetic evidence suggest that pluteus arms are novel larval organs, distinguishable from the processes of skeletogenesis per se. The dissociation of expression control in H. erythrogramma suggest that coordinate gene expression in H. tuberculata evolved as part of the evolution of pluteus arms, and is not required for larval or adult development. It was only a question of when, not if, the late rejection of Thomism in Catholic circles would be followed by the next tum toward the thought of the Angelic Doctor. This movement is already underway, and on the European continent two groups of young Dominicans are playing prominent roles. In Toulouse, though he (...) only assumed its editorship in 1991, S.-T. Bonino already has made the venerable Revue thomiste indispensable reading again. Two recent thematic issues are especially noteworthy: "Autour d'Etienne Gilson" (94 [1994): 355-553) and "S. Thomas et l'onto-theologie" (95 [1995): 1-192). Bonino's own bulletins et recensions are erudite and lively, and he is very clear about the present situation: After the decline of the last decades, Thomism is searching for a new 6lan, a new look, and not without success:... the corpse of Thomism is stirring again. Though the new look is not yet complete, one feature is set: One common point unites all now approaching the works of St. Thomas, whatever their ultimate goals: the necessity to put Thomistic doctrine into serious historical perspective.... Historical-doctrinal study of St. Thomas is opening the possibility of an authentic revival of Thomism. (Revue thomiste 95 [1995]: 485-6) While Anglo-Americans approaching Aquinas from neoscholastic or analytic perspectives might not be so enthusiastic about history, Fr. Bonino is simply correct. For evidence, he turns to the historical work of the other group of Dominicans, at Fribourg. Chief among them is J.-P. Torrell, whose masterful 1993 biography, Initiation d saint Thomas d'Aquin, is now in English, and was accompanied by a Festschrift for the eminent professor of theologyOrdo sapientiae et amoris, ed. C.-J. de Oliveira. Not least among Torrell's contributions has been to direct the thesis of Gilles Emery-La Trinite creatrice. One paragraph of Emery's helpful general conclusion reveals three dominant themes in his important work: In virtue of the nexus mysteriorum, faith in the Trinity clarifies faith in the creative and saving activity of God, while the doctrine of creation in its turn clarifies our approach to the mystery of the Trinity. It is this mutual clarification and support among the articles of faith that we mean by speaking of the "function" of the theme of the creative Trinity. The unity of the Trinity in its works ad extra constitutes a fundamental rule of the trinitarian theology of our scholastics. But it does not exhaust their theological discourse on the subject of God as creator. To arrive at a balanced doctrine, trying to give all the aspects of the mystery their due, one must add to the rule of unity a second rule, which completes it: the procession of the divine persons is the origin of the procession of creatures. (519) Emery's primary theme is captured in the title-The Creative Trinity. Creation involves not only the one God as efficient cause bestowing existence 494 BOOK REVIEWS on a multitude of creatures (rule 1), but also the Trinitarian multiplicity within God as exemplar cause of the procession of creatures (rule 2). The neoscholastics ignored rule 2, separating creation (which was turned over to the philosophers) from Trinity (the exclusive domain of the theologians). This too neat division oflabor produced unhappy consequences: a doctrine ofcreation with no role for the Trinity, and a doctrine of the Trinity with no function in creation. What can be called Emery's Trinitarian theme is a corrective for such mistakes. To understand this side of creation rightly, Emery situates Aquinas's thought in relation to Albert and Bonaventure, on whom he heavily depends. This is his hi,storical theme. From the development of these two principal themes there gradually emerges a third, less overt, but in the long run of signal importance for the new look of Thomism-what might be called the integration theme, uniting reason and revelation in Aquinas's theology. To break through the crust that had built up around Aquinas's genuine doctrine of creation Emery turns to history.
